{"id":5640,"date":"2023-09-19T18:57:43","date_gmt":"2023-09-19T18:57:43","guid":{"rendered":"https:\/\/dailyai.com\/?p=5640"},"modified":"2024-03-28T00:42:47","modified_gmt":"2024-03-28T00:42:47","slug":"the-evolution-of-ai-regulation-where-are-we-now","status":"publish","type":"post","link":"https:\/\/dailyai.com\/fr\/2023\/09\/the-evolution-of-ai-regulation-where-are-we-now\/","title":{"rendered":"L'\u00e9volution de la r\u00e9glementation de l'IA : o\u00f9 en sommes-nous ?"},"content":{"rendered":"<p><strong>In the not-so-distant past, conversations about AI were primarily confined to the realms of science fiction and academic papers.<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">Fast forward to today, and AI is deeply integrated into the fabric of daily life, from powering smart homes to diagnosing diseases.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">But as AI technology races ahead, regulatory frameworks are playing catch-up, often lagging behind the curve of innovation.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This presents humanity with a multifaceted puzzle \u2013 how do we craft laws and regulations that are agile enough to adapt to rapid technological change yet robust enough to protect societal interests?<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Across the globe, regulatory efforts are far from uniform. The European Union (EU) is setting the stage with its comprehensive AI Act, which aims to categorize and control AI applications based on their risk level.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Meanwhile, the US has favored voluntary commitments over immediate legislation. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">China, on the other hand, wields a tight grip on AI, aligning regulation with broader political and social governance goals.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">And let\u2019s not forget other jurisdictions \u2013 AI is a global phenomenon that will require near-universal legislative<\/span><span style=\"font-weight: 400;\">\u00a0coverage.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">So, where is regulation now, and how is it expected to progress?<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">The EU approach<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The EU has adopted a stringent framework with its groundbreaking AI Act, which is expected to be fully approved by the end of the year.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The AI Act specifies four tiers, including &#8220;unacceptable risk AIs,&#8221; &#8220;high-risk AIs,&#8221; &#8220;limited risks AIs,&#8221; and &#8220;low-risk AIs,&#8221; each with a specific set of guidelines and prohibitions.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Unacceptable risk AIs pose immediate or considerable dangers, such as causing physical or mental harm or infringing on human rights \u2013 and these will be outright banned.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">High-risk AIs are permitted but subject to strict regulations from risk management to technical documentation and cybersecurity.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Limited and low-risk AIs, on the other hand, remain predominantly unregulated but are required to maintain transparency with users.\u00a0<\/span><\/p>\n<figure id=\"attachment_944\" aria-describedby=\"caption-attachment-944\" style=\"width: 955px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-944 size-full\" src=\"https:\/\/dailyai.com\/wp-content\/uploads\/2023\/05\/ai-risk.png\" alt=\"AI Risk\" width=\"955\" height=\"463\" srcset=\"https:\/\/dailyai.com\/wp-content\/uploads\/2023\/05\/ai-risk.png 955w, https:\/\/dailyai.com\/wp-content\/uploads\/2023\/05\/ai-risk-300x145.png 300w, https:\/\/dailyai.com\/wp-content\/uploads\/2023\/05\/ai-risk-768x372.png 768w, https:\/\/dailyai.com\/wp-content\/uploads\/2023\/05\/ai-risk-370x179.png 370w, https:\/\/dailyai.com\/wp-content\/uploads\/2023\/05\/ai-risk-800x388.png 800w, https:\/\/dailyai.com\/wp-content\/uploads\/2023\/05\/ai-risk-740x359.png 740w, https:\/\/dailyai.com\/wp-content\/uploads\/2023\/05\/ai-risk-20x10.png 20w, https:\/\/dailyai.com\/wp-content\/uploads\/2023\/05\/ai-risk-99x48.png 99w\" sizes=\"auto, (max-width: 955px) 100vw, 955px\" \/><figcaption id=\"caption-attachment-944\" class=\"wp-caption-text\">EU AI Act risk levels: Source: EU.<\/figcaption><\/figure>\n<p><span style=\"font-weight: 400;\">There is one reprieve in the short term, as the legislation includes a grace period of about two years for companies to align with the new regulations.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The EU proposes that the original creators of AI models should be liable for how their technology is used, even when embedded into a different system by another company or developer.<\/span><span style=\"font-weight: 400;\"> There are also newly added rules for \u201cfoundation models,\u201d which include generative AI models.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Reception to the AI Act varies \u2013 some criticize its clumsy definitions and potential to sap innovation. For instance, there is considerable uncertainty over how different AI models sort into risk categories. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Additionally, smaller AI companies are worried they lack the resources to dedicate towards compliance.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">OpenAI CEO Sam Altman <\/span><a href=\"https:\/\/dailyai.com\/2023\/05\/openai-ceo-sam-altman-u-turns-on-leaving-the-european-market\/\"><span style=\"font-weight: 400;\">briefly threatened<\/span><\/a><span style=\"font-weight: 400;\"> to pull his company\u2019s products from the EU market if the AI Act specified requirements that can\u2019t be realistically adhered to.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In June, 150 large companies <\/span><a href=\"https:\/\/dailyai.com\/2023\/06\/150-major-european-companies-sound-the-alarm-about-the-eu-ai-act\/\"><span style=\"font-weight: 400;\">highlighted the Act\u2019s heavy-handed approach<\/span><\/a><span style=\"font-weight: 400;\">, stating the current rules risk destroying European competitiveness.\u00a0<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Divergence from the US<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">A <\/span><a href=\"https:\/\/hai.stanford.edu\/news\/analyzing-european-union-ai-act-what-works-what-needs-improvement\"><span style=\"font-weight: 400;\">Stanford analysis<\/span><\/a><span style=\"font-weight: 400;\"> of the AI Act discussed fundamental differences between the EU and US approaches to AI regulation. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Alex Engler, a fellow in Governance Studies at The Brookings Institution, said, \u201cThere\u2019s a growing disparity between the U.S. and the EU approach [to regulating AI].&#8221;\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">He highlights that the EU has pushed for data privacy and transparency laws, which remain mostly lacking in the US. Disparity confuses compliance for AI companies, and the costs associated with cross-jurisdictional compliance could be overbearing.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">&#8220;Corporate interests will fight tooth and nail if you have two dramatically different standards for online platforms,\u201d said Engler.<\/span><\/p>\n<p><iframe loading=\"lazy\" title=\"Decoding the EU Artificial Intelligence Act\" width=\"1080\" height=\"608\" src=\"https:\/\/www.youtube.com\/embed\/za5YYUIQIaM?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/p>\n<p><span style=\"font-weight: 400;\">Overall, when push comes to shove, it&#8217;s hard to envisage tech firms not finding a way to navigate the AI Act as they have done with GDPR and will have to with the recent Digital Services Act.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Speaking to the <\/span><a href=\"https:\/\/www.nature.com\/articles\/d41586-023-02491-y\"><span style=\"font-weight: 400;\">journal Nature<\/span><\/a><span style=\"font-weight: 400;\">, Daniel Leufer, a Senior Policy Analyst at Access Now, dismisses the AI industry&#8217;s objections to the Act as just \u201cthe usual showboating.\u201d\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">The UK approach<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Post-Brexit, the UK aims to capitalize on its independence from the EU to formulate a more flexible and sector-specific regulatory regime.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In contrast to the AI Act, the UK government intends to regulate the applications of AI rather than the underlying software itself.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">A \u201cpro-innovation\u201d stance<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">The UK government released a <\/span><a href=\"https:\/\/www.gov.uk\/government\/publications\/ai-regulation-a-pro-innovation-approach\/white-paper\"><span style=\"font-weight: 400;\">white paper in March<\/span><\/a><span style=\"font-weight: 400;\"> outlining a &#8220;pro-innovation&#8221; framework, inviting stakeholders to share their views. However, the government has yet to issue guidelines for implementing this framework. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">A statement says the &#8220;government will help the UK harness the opportunities and benefits that AI technologies present&#8221; \u2013 an approach criticized for not paying fair attention to AI-related harm. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">The government had even planned to offer AI firms an extremely controversial &#8216;copyright exemption&#8217; but <a href=\"https:\/\/dailyai.com\/2023\/08\/uk-government-embarks-on-u-turn-surrounding-ai-copyright-exemption\/\">U-turned on that plan<\/a> in August.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Britain has had a tough time attracting tech innovation lately, notably losing Cambridge chip manufacturer Arm, who opted to publicly list shares in the US rather than domestically. This is perhaps fueling the UK\u2019s anxiety to re-ignite its dwindling tech sector.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">To help position the UK as forward-thinking on AI, Prime Minister Rishi Sunak announced a two-day <\/span><a href=\"https:\/\/dailyai.com\/2023\/08\/bletchley-park-set-to-host-the-uks-global-ai-safety-summit-in-november\/\"><span style=\"font-weight: 400;\">AI Safety Summit<\/span><\/a><span style=\"font-weight: 400;\">\u00a0taking place in November.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Notably, China has been invited to the event \u2013 though there is speculation they\u2019ll be excluded over <\/span><a href=\"https:\/\/dailyai.com\/2023\/09\/rishi-sunak-to-potentially-ban-chinese-officials-from-ai-safety-summit\/\"><span style=\"font-weight: 400;\">espionage fears<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">The US approach<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">In the US, the focus is allowing the industry to self-regulate, at least for now.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The US Congress is signaling a &#8216;wait and see&#8217; approach, embarking on a review of AI closed-door meetings and Chuck Schumer\u2019s <\/span><a href=\"https:\/\/dailyai.com\/2023\/09\/the-first-ai-forum-when-tech-titans-lawmakers-and-critics-converge\/\"><span style=\"font-weight: 400;\">AI Insight Forums<\/span><\/a><span style=\"font-weight: 400;\"> to determine where precisely AI requires new regulation.<\/span><\/p>\n<figure id=\"attachment_4807\" aria-describedby=\"caption-attachment-4807\" style=\"width: 1000px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-4807 size-full\" src=\"https:\/\/dailyai.com\/wp-content\/uploads\/2023\/08\/shutterstock_1792777996.jpg\" alt=\"AI schumer\" width=\"1000\" height=\"667\" srcset=\"https:\/\/dailyai.com\/wp-content\/uploads\/2023\/08\/shutterstock_1792777996.jpg 1000w, https:\/\/dailyai.com\/wp-content\/uploads\/2023\/08\/shutterstock_1792777996-300x200.jpg 300w, https:\/\/dailyai.com\/wp-content\/uploads\/2023\/08\/shutterstock_1792777996-768x512.jpg 768w, https:\/\/dailyai.com\/wp-content\/uploads\/2023\/08\/shutterstock_1792777996-370x247.jpg 370w, https:\/\/dailyai.com\/wp-content\/uploads\/2023\/08\/shutterstock_1792777996-800x534.jpg 800w, https:\/\/dailyai.com\/wp-content\/uploads\/2023\/08\/shutterstock_1792777996-20x13.jpg 20w, https:\/\/dailyai.com\/wp-content\/uploads\/2023\/08\/shutterstock_1792777996-740x494.jpg 740w, https:\/\/dailyai.com\/wp-content\/uploads\/2023\/08\/shutterstock_1792777996-72x48.jpg 72w\" sizes=\"auto, (max-width: 1000px) 100vw, 1000px\" \/><figcaption id=\"caption-attachment-4807\" class=\"wp-caption-text\">Majority Leader of the United States Senate, Chuck Schumer, announced a series of AI Insight Forums to discuss AI regulation. Source: Shutterstock.<\/figcaption><\/figure>\n<p><span style=\"font-weight: 400;\">Bipartisan agreements might revolve around narrowly tailored legislation addressing privacy, platform transparency, or <\/span><a href=\"https:\/\/dailyai.com\/2023\/09\/us-state-prosecutors-are-pressuring-congress-to-protect-children-from-ai\/\"><span style=\"font-weight: 400;\">protecting children online<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Additionally, some have highlighted that existing laws and regulations remain relevant to AI.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In June, <\/span><a href=\"https:\/\/dailyai.com\/2023\/06\/ftc-chair-lina-khan-urges-early-vigilance-on-ai-to-prevent-abuse\/\"><span style=\"font-weight: 400;\">Khan said<\/span><\/a><span style=\"font-weight: 400;\">, \u201cThere is no AI exemption from laws prohibiting discrimination\u2026As this stuff becomes more embedded in how daily decisions are being made, I think they invite and merit a lot of scrutiny\u2026I think enforcers, be it at the state level or the national level, are going to be acting.\u201d<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Voluntary frameworks and stop-gaps<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Prominent tech companies like Microsoft, OpenAI, Google, Amazon, and Meta recently <\/span><a href=\"https:\/\/dailyai.com\/2023\/09\/more-ai-companies-join-the-us-voluntary-framework-on-ai\/\"><span style=\"font-weight: 400;\">signed voluntary commitments for safe AI development<\/span><\/a><span style=\"font-weight: 400;\">, including conducting internal and external AI model testing before public release.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Many tech industry leaders have come forward with their own pledges, but in <\/span><span style=\"font-weight: 400;\">the absence of robust legislative oversight, the sincerity of these promises is yet to be tested.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">All in all, critics claim that the US&#8217;s approach is essentially symbolic, lacking the depth and commitment of the EU&#8217;s AI Act. The first <a href=\"https:\/\/dailyai.com\/2023\/09\/the-first-ai-forum-when-tech-titans-lawmakers-and-critics-converge\/\">AI Insight Forum<\/a> was a largely closed-door event that some criticized as restricting open debate. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Senator Josh Hawley said the event was a \u201cgiant cocktail party.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As Ryan Calo, Professor at the University of Washington School of Law, aptly summarized, \u201cThere\u2019s the appearance of activity, but nothing substantive and binding.\u201d<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">The Chinese Approach<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">China, proportionate to its appetite for state control, is imposing some of the most stringent regulations on AI.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The emphasis is on controlling AI\u2019s dissemination of information, reflecting China&#8217;s broader political and social governance frameworks.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For instance, generative AI providers whose products can &#8220;impact public opinion&#8221; are required to submit for security reviews.<\/span><\/p>\n<p><span style=\"font-weight: 400;\"> The first wave of approved chatbots, including Baidu&#8217;s ERNIE Bot, was recently <\/span><a href=\"https:\/\/dailyai.com\/2023\/08\/first-generative-ai-tools-receive-approval-for-public-rollout-in-china\/\"><span style=\"font-weight: 400;\">released to the public<\/span><\/a><span style=\"font-weight: 400;\"> and found to censor politically-themed questions.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The surge of &#8216;deep fakes&#8217; and AI-generated content poses challenges worldwide, and China is no exception. Recognizing the potential pitfalls of AI relatively early in the year, the Cyberspace Administration of China (CAC) requires AI-driven content generators to undergo identity verification processes on users.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Furthermore, watermarking provisions have been introduced to distinguish AI-generated content from human-created ones, rules that Western powers also seek to implement.\u00a0<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">US and China divergence<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">AI has accelerated friction between the US and China, sparking what many have termed a &#8220;Digital Cold War\u201d \u2013 or perhaps more appropriately, an \u201cAI Cold War.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">US restrictions on collaboration and trade with China are nothing new, but the decoupling of the two countries sprung forward a step when Xi Jinping announced his new, reformed <\/span><a href=\"https:\/\/dailyai.com\/2023\/05\/china-scrambles-forward-in-the-race-for-ai-supremacy\/\"><span style=\"font-weight: 400;\">Made in China 2025 plan<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This aims to make China 70% self-sufficient in crucial technology sectors by 2025, including high-end AI technology. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Currently, the US is <\/span><a href=\"https:\/\/dailyai.com\/2023\/08\/biden-curbs-us-tech-investments-in-china-over-security-concerns\/\"><span style=\"font-weight: 400;\">severing funding and research<\/span><\/a><span style=\"font-weight: 400;\"> ties with China while subjugating their procurement of AI chips from companies like Nvidia.\u00a0\u00a0<\/span><\/p>\n<figure id=\"attachment_5641\" aria-describedby=\"caption-attachment-5641\" style=\"width: 800px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-5641 size-full\" src=\"https:\/\/dailyai.com\/wp-content\/uploads\/2023\/09\/MIC2025_logo.png\" alt=\"Made in China\" width=\"800\" height=\"372\" srcset=\"https:\/\/dailyai.com\/wp-content\/uploads\/2023\/09\/MIC2025_logo.png 800w, https:\/\/dailyai.com\/wp-content\/uploads\/2023\/09\/MIC2025_logo-300x140.png 300w, https:\/\/dailyai.com\/wp-content\/uploads\/2023\/09\/MIC2025_logo-768x357.png 768w, https:\/\/dailyai.com\/wp-content\/uploads\/2023\/09\/MIC2025_logo-370x172.png 370w, https:\/\/dailyai.com\/wp-content\/uploads\/2023\/09\/MIC2025_logo-740x344.png 740w, https:\/\/dailyai.com\/wp-content\/uploads\/2023\/09\/MIC2025_logo-20x9.png 20w, https:\/\/dailyai.com\/wp-content\/uploads\/2023\/09\/MIC2025_logo-103x48.png 103w\" sizes=\"auto, (max-width: 800px) 100vw, 800px\" \/><figcaption id=\"caption-attachment-5641\" class=\"wp-caption-text\">China&#8217;s Made in China strategy was reformed after a corruption probe. Source: <a href=\"https:\/\/en.wikipedia.org\/wiki\/Made_in_China_2025#\/media\/File:MIC2025_logo.png\">Wikipedia<\/a>.<\/figcaption><\/figure>\n<p><span style=\"font-weight: 400;\">While the US has a clear head start in the race for AI dominance, China has a few tricks up its sleeve, including a centralized approach to regulation and near-limitless personal data.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In May, Edith Yeung, a Race Capital investment firm partner, <\/span><a href=\"https:\/\/www.bbc.co.uk\/news\/business-65034773\"><span style=\"font-weight: 400;\">told the BBC<\/span><\/a><span style=\"font-weight: 400;\">, \u201cChina has a lot less rules around privacy, and a lot more data [compared to the US]. There\u2019s CCTV facial recognition everywhere, for example.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">China\u2019s closely aligned government and tech industry also yields advantages, as data sharing between its government and domestic tech firms is virtually seamless.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The US and other Western jurisdictions don\u2019t share the same access to business and personal data, which is the lifeblood of machine learning models. In fact, there are already concerns that high-quality <\/span><a href=\"https:\/\/dailyai.com\/2023\/06\/what-happens-when-ai-starts-consuming-its-own-output\/\"><span style=\"font-weight: 400;\">data sources are \u2018running out.<\/span><\/a><span style=\"font-weight: 400;\">\u2019\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Moreover, Western AI companies\u2019 liberal use of potentially copyright training data has caused widespread uproar and <a href=\"https:\/\/dailyai.com\/2023\/08\/inside-the-battle-between-artists-and-ai-image-generators\/\">lawsuits. <\/a><\/span><\/p>\n<p><span style=\"font-weight: 400;\">China\u2019s AI companies will likely not suffer from that problem.\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Balancing accessibility and risk<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">AI was once confined to academia and large enterprises. Within a year or so, between a quarter and a half of adults in the UK, US, and EU have used generative AI.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Accessibility has many advantages, including spurring innovation and reducing entry barriers for startups and individual developers.
