Es wird voraussichtlich im Mai dieses Jahres in Kraft treten.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Mit dem KI-Gesetz wird ein neuartiger, risikobasierter Ansatz f\u00fcr die KI-Governance eingef\u00fchrt. Es kategorisiert KI-Systeme auf der Grundlage ihrer potenziellen Bedrohungen und reguliert sie entsprechend.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Die EU-Gesetzgebung ist bekannterma\u00dfen komplex, und dies ist der H\u00f6hepunkt mehrj\u00e4hriger Bem\u00fchungen und einiger brenzliger Momente, in denen einige L\u00e4nder hinsichtlich der Auswirkungen des Gesetzes auf ihre Wirtschaft und ihren Wettbewerb z\u00f6gerten. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Im Juni letzten Jahres wurde die Entwicklung des Unternehmens erneut gebremst, als rund 150 gro\u00dfe europ\u00e4ische Unternehmen <\/span><a href=\"https:\/\/dailyai.com\/de\/2023\/06\/150-major-european-companies-sound-the-alarm-about-the-eu-ai-act\/\"><span style=\"font-weight: 400;\">gewarnt vor<\/span><\/a><span style=\"font-weight: 400;\"> die Verfolgung restriktiver Vorschriften.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Das Warten hat endlich ein Ende. Von allt\u00e4glichen Werkzeugen wie Spam-Filtern bis hin zu komplexeren Systemen, die im Gesundheitswesen und bei der Strafverfolgung eingesetzt werden, ist das KI-Gesetz sehr umfassend.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Zu den bemerkenswertesten Bestimmungen des Gesetzes geh\u00f6rt das vollst\u00e4ndige Verbot von KI-Systemen, die kognitive Verhaltensmanipulationen, soziales Scoring und nicht autorisierte biometrische Identifizierung erm\u00f6glichen.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Dann gibt es noch die \"Hochrisikokategorie\", zu der KI in kritischen Infrastrukturen, Bildungsinstrumenten, Besch\u00e4ftigungsmanagement und mehr geh\u00f6rt. Diese Systeme werden vor und nach der Markteinf\u00fchrung strengen Bewertungen unterzogen. Die \u00d6ffentlichkeit hat die M\u00f6glichkeit, diese KI-Systeme bei den zust\u00e4ndigen Beh\u00f6rden anzumelden.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Generative KI, wie ChatGPT von OpenAI, wird in dem Gesetz besonders hervorgehoben. Auch wenn diese Plattformen nicht als hochriskant eingestuft werden, wird von ihnen erwartet, dass sie ihre Arbeitsweise und die Daten, auf denen sie trainieren, transparent machen und sich dabei an die EU-Urheberrechtsvorschriften halten.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Im Folgenden finden Sie eine kurze Zusammenfassung der wichtigsten Bestimmungen des Gesetzes:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Verbotene KI-Systeme<\/b><span style=\"font-weight: 400;\">: Kognitive Verhaltensmanipulation, soziale Bewertung, unbefugte biometrische Identifizierung und Gesichtserkennung in Echtzeit oder aus der Ferne.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Hochriskante KI-Systeme<\/b><span style=\"font-weight: 400;\">: Im Zusammenhang mit kritischen Infrastrukturen, allgemeiner\/beruflicher Bildung, Produktsicherheitskomponenten, Besch\u00e4ftigung und Arbeitnehmermanagement, wesentlichen privaten und \u00f6ffentlichen Dienstleistungen, Strafverfolgung, Migration\/Asyl\/Grenzkontrolle und Justizverwaltung\/Demokratie.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Bewertung und Beschwerden<\/b><span style=\"font-weight: 400;\">: KI-Systeme mit hohem Risiko werden vor der Markteinf\u00fchrung und w\u00e4hrend ihres gesamten Lebenszyklus einer Bewertung unterzogen. Einzelpersonen haben das Recht, bei den nationalen Beh\u00f6rden Beschwerde einzulegen.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Generative KI<\/b><span style=\"font-weight: 400;\">: Systeme wie ChatGPT m\u00fcssen die Transparenzanforderungen und das EU-Urheberrecht erf\u00fcllen, einschlie\u00dflich der Offenlegung von KI-generierten Inhalten, der Verhinderung der Erzeugung illegaler Inhalte und der Zusammenfassung urheberrechtlich gesch\u00fctzter Daten, die f\u00fcr das Training verwendet wurden.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Zeitplan f\u00fcr die Umsetzung<\/b><span style=\"font-weight: 400;\">: Das KI-Gesetz soll Mitte 2024 in Kraft treten, wobei die Bestimmungen \u00fcber zwei Jahre hinweg schrittweise eingef\u00fchrt werden. Verbotene Systeme m\u00fcssen innerhalb von sechs Monaten abgeschafft werden, Regeln f\u00fcr allgemeine KI gelten nach einem Jahr, und die vollst\u00e4ndige Durchsetzung beginnt zwei Jahre nach Inkrafttreten des Gesetzes.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Geldbu\u00dfen<\/b><span style=\"font-weight: 400;\">: Die Nichteinhaltung kann zu Geldstrafen von bis zu 35 Millionen Euro oder 7% des weltweiten Jahresumsatzes f\u00fchren.<\/span><\/li>\n<\/ul>\n<p>Neben der Regulierung der KI-Ausbildung und des KI-Einsatzes waren die Urheberrechtsvorschriften einer der am meisten erwarteten Aspekte des Gesetzes. Dazu geh\u00f6ren einige der folgenden Punkte:<\/p>\n<ul>\n<li>KI-Modelle, die f\u00fcr ein breites Spektrum von Anwendungen konzipiert sind, m\u00fcssen Zusammenfassungen der von ihnen verwendeten Trainingsdaten offenlegen.<\/li>\n<li>Die Angaben sollten so detailliert sein, dass die Urheber erkennen k\u00f6nnen, ob ihre Inhalte in der Ausbildung verwendet wurden.<\/li>\n<li>Diese Anforderung gilt auch f\u00fcr Open-Source-Modelle.<\/li>\n<li>Alle \u00c4nderungen an diesen Modellen, wie z. B. die Feinabstimmung, m\u00fcssen auch Informationen \u00fcber die verwendeten Trainingsdaten enthalten.<\/li>\n<li>Diese Vorschriften gelten f\u00fcr alle Modelle, die auf dem EU-Markt angeboten werden, unabh\u00e4ngig davon, wo sie entwickelt wurden.<\/li>\n<li>Kleine und mittlere Unternehmen (KMU) werden mit einer flexibleren Durchsetzung konfrontiert, m\u00fcssen aber weiterhin die Urheberrechtsvorschriften einhalten.<\/li>\n<li>Die bestehende Bestimmung, nach der Urheber ihre Werke von der Verwendung in der KI-Ausbildung ausschlie\u00dfen k\u00f6nnen, bleibt bestehen.<\/li>\n<\/ul>\n<p>Dies scheint ein Schritt nach vorn zu sein, um zu verhindern, dass die Daten von Personen ohne deren Zustimmung f\u00fcr das Training von KI-Modellen verwendet werden.<\/p>\n<p><span style=\"font-weight: 400;\">Die Bestimmungen des KI-Gesetzes, das Mitte 2024 formell in Kraft treten soll, werden schrittweise in Kraft treten. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Die EU erwartet, dass verbotene KI-Praktiken oder -Projekte innerhalb von sechs Monaten eingestellt werden.
