They\u2019ve created powerful models that generate realistic, natural-sounding music from text prompts in just seconds.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The lawsuits, coordinated by the Recording Industry Association of America (RIAA), allege that developing these models involved <\/span><span style=\"font-weight: 400;\">&#8220;mass infringement of copyrighted sound recordings.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Plaintiffs include the likes of Universal Music Group, Sony Music Entertainment, and Warner Records.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">They argue that Suno and Udio &#8220;stole copyrighted sound recordings&#8221; to train their AI, and that the AI-generated music these services produce could &#8220;saturate the market with machine-generated content that will directly compete with, cheapen, and ultimately drown out the genuine sound recordings.&#8221;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Evidence of that has already surfaced, with wholly AI-generated tunes <\/span><a href=\"https:\/\/dailyai.com\/2024\/05\/ai-generated-songs-rack-up-thousands-of-listens-on-spotify\/\"><span style=\"font-weight: 400;\">racking up thousands of plays<\/span><\/a><span style=\"font-weight: 400;\"> on Spotify despite the platform vowing to oppose them.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In April 2024, over <\/span><a href=\"https:\/\/dailyai.com\/2024\/04\/200-artists-warn-about-generative-meddling-in-music\/\"><span style=\"font-weight: 400;\">200 prominent artists<\/span><\/a><span style=\"font-weight: 400;\">, including Billie Eilish, Nicki Minaj, Pearl Jam, R.E.M, Chase &amp; Status, and Jon Bon Jovi, vowed to combat AI music. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">In May, Sony Music <\/span><a href=\"https:\/\/dailyai.com\/2024\/05\/sony-music-group-issues-ai-training-data-warning-to-700-companies\/\"><span style=\"font-weight: 400;\">issued warnings<\/span><\/a><span style=\"font-weight: 400;\"> to 700 companies, warning, \u201cWe have reason to believe that you may already have made unauthorized uses of our music.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The writing was on the wall. It was only ever a case of when, not if, lawsuits would strike text-to-music AI models.\u00a0<\/span><\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">The suit is a landmark moment for AI in the music industry.<\/p>\n<p>UMG previously sued AI company <span class=\"noTranslate\"><span class=\"noTranslate\"><span class=\"noTranslate\"><span class=\"noTranslate\"><span class=\"noTranslate\"><span class=\"noTranslate\"><span class=\"noTranslate\"><span class=\"noTranslate\"><span class=\"noTranslate\"><span class=\"noTranslate\"><span class=\"noTranslate\"><span class=\"noTranslate\"><span class=\"noTranslate\"><span class=\"noTranslate\"><span class=\"noTranslate\"><span class=\"noTranslate\"><span class=\"noTranslate\"><span class=\"noTranslate\"><span class=\"noTranslate\"><span class=\"noTranslate\">Anthropic<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span> for using lyrics to train its AI model <span class=\"noTranslate\"><span class=\"noTranslate\"><span class=\"noTranslate\"><span class=\"noTranslate\"><span class=\"noTranslate\"><span class=\"noTranslate\"><span class=\"noTranslate\"><span class=\"noTranslate\"><span class=\"noTranslate\"><span class=\"noTranslate\"><span class=\"noTranslate\"><span class=\"noTranslate\"><span class=\"noTranslate\"><span class=\"noTranslate\"><span class=\"noTranslate\"><span class=\"noTranslate\"><span class=\"noTranslate\"><span class=\"noTranslate\"><span class=\"noTranslate\"><span class=\"noTranslate\">Claude<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span>, now a music company is suing an AI company over actual recordings.<\/p>\n<p>More: <a href=\"https:\/\/t.co\/FdDlsRbPcD\">https:\/\/t.co\/FdDlsRbPcD<\/a> <a href=\"https:\/\/t.co\/yE3IaOG0bJ\">https:\/\/t.co\/yE3IaOG0bJ<\/a><\/p>\n<p>\u2014 Rolling Stone (@RollingStone) <a href=\"https:\/\/twitter.com\/RollingStone\/status\/1805257800710275266?ref_src=twsrc%5Etfw\">June 24, 2024<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<h2>The fair use conundrum<\/h2>\n<p><span style=\"font-weight: 400;\">With this lawsuit, an increasingly familiar debate will resurface once more: does training AI on copyrighted works constitute &#8220;fair use&#8221; under copyright law?\u00a0<\/span><\/p>\n<p>AI companies like OpenAI, Google, and Anthropic argue it does. And with no widely accepted or legally ratified answer, they&#8217;re yet to be proven wrong.<\/p>\n<p><span style=\"font-weight: 400;\">While this is the first audio-related lawsuit, cases in the writing and visual arts have been in progress since mid-2023. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Progress, however, has been grueling.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">First, while an AI model can produce something that looks, reads, or sounds exactly like someone\u2019s work, it will unlikely be identical. This is especially true for art and music, where the output typically differs enough from the original to avoid being an exact copy.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For text, an AI model could produce a verbatim passage from, say, Harry Potter or Lord Of The Rings, but it may have picked up the text from a forum or third-party website rather than the original works.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Secondly, AI companies curated datasets from numerous sources, including long-standing <a href=\"https:\/\/dailyai.com\/2023\/12\/stanford-researchers-identify-illicit-child-imagery-in-the-laion-dataset\/\">public datasets like LAION<\/a>. In this case, copyright infringement might have occurred at the point the dataset was created and not when it was used by the AI company.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Thirdly, violating copyright sometimes requires the reproduced work to directly harm in some way the copyright holder. Applying that to something as large-scale as an AI model is tricky, as the model itself is &#8216;just a tool.&#8217; AI companies argue that those who use it accept copyright liabilities rather than the developers.\u00a0<\/span><\/p>\n<p>Finally, the legal landscape around AI and copyright challenges existing frameworks, especially as AI evolves faster than lawsuits can resolve.<\/p>\n<p>The RIAA will have to tackle some of these challenges head-on. It will take time, but the scale and force behind this lawsuit are palpable.<\/p>\n<h2>The RIAA throws down the gauntlet<\/h2>\n<p><span style=\"font-weight: 400;\">The RIAA asserts that using music to train AI models does not constitute fair use, claiming &#8220;Fair use is not available when the output seeks to &#8216;substitute&#8217; for the work copied. And Suno and Udio have, in their own words, conceded that is exactly what they intend.&#8221;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The RIAA claims there is strong evidence Suno and Udio used copyrighted music without permission.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It cites comments from a Suno investor <\/span><a href=\"https:\/\/www.musicbusinessworldwide.com\/suno-could-get-sued-by-the-record-business-whos-backing-it-with-125m\/\"><span style=\"font-weight: 400;\">who said<\/span><\/a>, &#8220;If [Suno] had deals with labels when this company got started, I probably wouldn&#8217;t have invested in it,&#8221; and Udio executives who stated their AI was trained on &#8220;a large amount of publicly available<span style=\"font-weight: 400;\">\u00a0and high-quality music&#8221; obtained from the internet.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to the RIAA, the companies were &#8220;caught&#8221; using copyrighted material because &#8220;producer tags&#8221; with artist names appeared in the AI-generated music.<\/span><\/p>\n<p>Moreover, it&#8217;s become largely irrefutable that the models can create music that imitates the real thing.<\/p>\n<p><span style=\"font-weight: 400;\">Musician and AI music expert Ed Newton-Rex has also <a href=\"https:\/\/dailyai.com\/2024\/04\/200-artists-warn-about-generative-meddling-in-music\/\">published analyses<\/a> finding striking similarities between Suno and Udio&#8217;s outputs and hit songs by artists like Ed Sheeran, ABBA, and Coldplay.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Newton-Rex wrote in <\/span><a href=\"https:\/\/www.musicbusinessworldwide.com\/suno-is-a-music-ai-company-aiming-to-generate-120-billion-per-year-newton-rex\/\"><span style=\"font-weight: 400;\">Music Business Worldwide<\/span><\/a><span style=\"font-weight: 400;\">, \u201cI, and others, have found that Suno regularly outputs music that closely resembles copyrighted material. This is true across musical style, melodies, chord sequences, instrumental parts and lyrics. In this post, I will share some examples, and evaluate what they mean.\u201d<\/span><\/p>\n<p>Labels can use specialized prompts to coax models into replicating songs as closely as possible, which will likely be key evidence for the case.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">Pretty amazing stuff from the Udio\/Suno lawsuits. Record labels were able to basically recreate versions of very famous songs with highly specific prompts, then linked to them in the lawsuits. I made a short compilation here:<a href=\"https:\/\/t.co\/9Nu7rW7eqD\">https:\/\/t.co\/9Nu7rW7eqD<\/a> <a href=\"https:\/\/t.co\/5fQaD0wQ2I\">pic.twitter.com\/5fQaD0wQ2I<\/a><\/p>\n<p>\u2014 Jason Koebler (@jason_koebler) <a href=\"https:\/\/twitter.com\/jason_koebler\/status\/1805301151543476314?ref_src=twsrc%5Etfw\">June 24, 2024<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p><span style=\"font-weight: 400;\">Armed to fight Udio and Suno on several quarters, the RIAA is clearly bullish, <\/span><a href=\"https:\/\/www.riaa.com\/record-companies-bring-landmark-cases-for-responsible-ai-againstsuno-and-udio-in-boston-and-new-york-federal-courts-respectively\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">stating<\/span><\/a><span style=\"font-weight: 400;\">, &#8220;These are straightforward cases of copyright infringement involving unlicensed copying of sound recordings on a massive scale&#8221; and &#8220;These lawsuits are necessary to reinforce the most basic rules of the road for the responsible, ethical, and lawful development of generative AI systems.&#8221;<\/span><\/p>\n<h2>Another can of worms opens<\/h2>\n<p><span style=\"font-weight: 400;\">The lawsuits keep mounting up. Each one seems larger and more complex than the last.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Suno and Udio, valued at $125 million and backed by top VC firms, are now in the sights of some of the world\u2019s most influential media companies.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The complaints assert, &#8220;AI companies, like all other enterprises, must abide by the laws that protect human creativity and ingenuity. There is nothing that exempts AI technology from copyright law or that excuses AI companies from playing by the rules.&#8221;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">RIAA\u2019s statement also offers opinions from several influential industry voices backing the lawsuit. They don\u2019t mince their words.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Tino Gagliardi, president of the American Federation of Musicians of the US and Canada, called this \u201cthe theft of our members\u2019 instrumental sound recordings\u2014copied and exploited without permission by artificial intelligence.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In a similar vein, the Music Workers Allowance (MWA) said, \u201cThese corporations steal our work to create sound-alikes, effectively forcing us into a \u2018training\u2019 role to which we never consented. Their more expensive subscriptions allow users to commercialize the outputs, placing us in unfair competition with an inexhaustible supply of knock-offs of our own work, published without any credit or acknowledgement of our role in their creation.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Music labels have pulled the trigger on what could be the most influential AI lawsuits yet.
